Before becoming a teacher, I worked for the Unemployment
Agency in Michigan. My advice to you is to understand that
the appeal you will be going to is based in the law. The
appeals process is a legal process. So many people think that
they just have to tell a sad enough story and they'll get
benefits. Thats not the case.
An Unemployment claims appeal, either written or in front of a
judge/magistrate must address Unemployment law. You just
can't get up there and say you can't get a job and need this
money. Well you can, and people do all the time, but you'll
be denied. Nearly every appeal is turned down because people
go into the proceeding and think they just have to really,
really prove they need it and they'll get it. You need to
come to the appeal and cite sections of the law.
Your rejection letter should state why you aren't qualified
for the extension and which section of the law was used to
determine your ineligibility. Your appeal should sound
something like this: "According to section 301a (b) of the
State Unemployment Act.... My situation applies to this act
because...." Cut and dry legal facts. They don't care that
you need the money, can't pay bills, etc. They see it every
day and you're either eligible or not based on the law.
So, if you can't point to some legal fact that implies that
the agency's ineligibility determination was in error, or
bring new evidence regarding your employment record that they
did not have at the time or that was in error, your appeal
will probably not go anywhere.
