    Re: Guidance Counselor Confidentiality?
    Posted by Dave on 7/03/08

If subpoenaed a counselor must provide records of meetints
with the student named in the court order. The extent of the
information that a counselor must provide is a gray area -
I've learned that keeping general records of meetings with
students with key words is sufficient to protect
confidentiality while providing you with enough information
to recollect what you discussed during as specific meeting.
Now there are limits to confidentiality that a counselor must
inform (informed consent) their clients about in the
beginning of their therapeutic relationship. Subpoenaed
records is one limit; another is if the person is at risk of
harming themselves or others; and if the person is being
abused or abusing others younger than 18 (if the person is
under 18). A counselor can maintain confidentiality and
guarantee it as long as none of the above instances takes
place. However, there are a lot of gray areas about
confidentiality, especially in NYS (e.g. a 15 yr. old informs
you that she is pregnant and asks you to promise her that you
will not tell her parents - you ulimately must tell them and
encourage her to do so during that meeting via phone or in
person to protect her health and yourself). I hope this
helps your search for an answer.
