Hang on, take a deep breath.
If the kid can lsiten to the headphones in the class and still
pass the course, let it be. She's not hurting anyone.
If she refuses to work and doesn't mind failing, leave her be;
you can't force a teenager to work. As long as she's not
disturbing the class, fine.
But....
You still have an obligation to report this to the parent
right away. Tell them what's going on, then leave them to
decide what they'll do.
If the parents won't support the school on the cell phone
policy, there's not much you can do.
