    Mari is correct. If the teacher is already able to work here
    legally, then it is about who they prefer to hire. If the
    teacher's visa is based on this job offer... then they will have
    some 'splaining to do.

    I am not a US citizen, but my husband and children are. I am,
    however, a permanent resident alien which gives me the right to
    legally work and reside in the US.

    But when I first came here on a temp. visa (before I met my
    hubby) my district had to submit paperwork saying that my job
    could not be filled by a citizen. At the time, there was a
    teacher shortage in the area so it was true. I had several
    principals fighting for me. Had I not married a US citizen (my
    original plan was just to come to the California for a year or 2
    and then move back home... but fate had other ideas) I probably
    would not have been able to stay too long.... as the shortage
    didn't last.

    My friend who is a special ed teacher did get her green card the
    hard way... but she had to pay a bundle for lawyers and to have
    her own job advertised across the country in case a qualified
    citizen wanted it. In her case, they had such a shortage in
    special ed it didn't matter if someone wanted her job... there
    were plenty to go around and she was able to stay put.
    Actually, her going through that process helped her district as
    a few out of state special ed teachers applied and were hired
    due to her ad!!!!
