Most of those rulse are imposed by the organization. This is done
to prevent disclosure of protected, private information and the
spewing of unfounded, undocumented "facts" by the former employer.
Likely a private school doesn't have a legal department or even a
knowledgeble HR department.
Its not illegal to state that someone was terminated and would not
be rehired. However, you do expose the organization to risk if you
state the employee got fired for stealing, unless in the unlikely
situation where the employee signed a statement admitting stealing
and/or he was convicted in a court. Likewise, stating the employee
was "always late" is a mistake because the term "always" is very
relative. For that matter so is "late." However, if you were
terminated for documented violations of the company's attendance
policies, they might say so.
Either of these situations could lead to lawsuits, though they
almost certainly wouldn't be sucessful lawsuits because they're so
hard to prove. But, most employers don't want the headache, so they
are very tight lipped about references. Why expose yourself when
there's no gain for you.
Most schools in my area ask me if we would rehire. After the
answer, they usually ask if I have anything to add. If its a good
person, I will sing their virtues. If not, I'll usually say
nothing,but that speaks volumes.
