There are two issues here--leaving out information from a
resume and leaving out information from a job application.
I really don't think there is anything illegal about leaving
information off a resume. It often isn't possible to include
everything on a resume anyway. As far as the job application
is concerned, it might be a little bit more tricky. However,
if the long-term job ended and you received the negative
evaluation after that, you really weren't fired, asked to
leave, or dismissed from the job. If you leave out this
information, you might not be violating any law.
Two thoughts. You said that last year's superintendent
offered you a positive recommendation at the time. If you do
decide to include this job on an employment application, list
this superintendent as the one to contact. You could also
call this superintendent directly, tell him how much you
enjoyed working in his district, and ask him for a
recommendation. Yes, I know that it sounds crazy, but it
could be worth a try.
I disagree with the union rep--please consider contacting a
lawyer, one who is well-experienced in labor issues. Union
reps are often great people, but they are not experts in
labor law and defamation of character lawsuits. I know from
experience; I'm a retired teacher who worked with lots of
union reps over the years. Some were great people who really
knew what they were doing, while others meant well, but
weren't effective. If you decide to leave teaching, you will
probably need more education and this will be costly.
Spending money on a good labor attorney now might be money
very well spent. Please consider it.
