Accidentally Pushed NJ Teacher Denied Disability Pension
NJ Teacher accidently pushed by running students...(felt through heavy winter coat)...goes up into the air because of presence of ice...falls to ground in a "pratfall"...hits :head,shoulders,back,leg s,back of knees...heels of feet... then Principal yells to gaurd"...get her out of here!"....(principal does not send for medical officer)pulled,by wrists to feet by PRINCIPAL & Gaurd...REDROPPED to ground,because she screamed in pain for them to "please don't do that!"Again hits head shoulders & pelvic area...suffered contusions,hemotoma, over ten hours of surgery to repair rotater cuff tear because "arm was literally pulled apart". Findings of ALJ :did not accept accidental push...and "aid" given by "co-workers" considered not mitigating nor worthy of merit !...TEACHER DENIED ACCIDENTAL DISABILITY...now wears brace,walks with cane,cannot even substitute teach...Appelate Division upholds ALJ findings....is being appealed by TEACHER to the Supreme Court of NJ...I feel it should be followed and investigated.
