It has now passed the deadline for resignations in our
school system (Russell County). I have decided that I would
like to stay home with our kids, and I want to submit my
resignation now instead of waiting until next summer. My
main concern is my retirement account with the system.

If I break my contract, can they (Russell County Schools)
keep all or part of my retirement account as a penalty for
my breaking it? I know if I opt to have the retirement
returned to me (which is what I'd prefer) then Uncle Sam
will take his share...but I just want to make sure of
whether or not they can use the breaking of my contract to
keep the rest of my retirement.

I have been with the school system for eight years. I have
tenure, but I am not yet vested. Don't know if that will
affect the out come or your answers.
