He can't test out because he has not reached proficiency levels. Are you saying the student has been in the ESOL program since 2nd grade? Refer to his ACCESS score to tailor your instruction for him. This a student who may need a screening for a learning disability which may be masking itself as a second language issue. I know it may be hard to tell the difference so a special ed. diagnostician may help!
