Is it legal to have 27 students in a first grade class in West Virginia?

Hmm My class had 29 begining of the year. I demanded they make another class or hire an Aide. They refused so I went to the WVEA AND TO the State level. We now have two class rooms for second Grade.

1st grade teacher I am the original poster. I have had 26 students in my first grade class all year. I am getting a new student next week, bringing my class size to 27. I am getting conflicting information about class size limits for first grade. A WVEA rep in another school told me that it was illegal to have more than 25. State Code From what I read, the limit is 25, but they can give you three above with compensation. Here's the code:

1st grade teacher Thank you! This section seems to imply that since 1996, 1st, 2nd, and 3rd grade classrooms cannot have any pupils over the 25-student limit. Am I interpreting this incorrectly?

hmm Another thing to remember is the size of your room. There has to be an X amount of space and clearance for X amount of kids or it is a fire code violation as well.
