class size/sending kids to a different school

What rights do I have to keep my daughter at the elementary school she should attend?? To try to keep this short, the school is proposing sending 5 children to another school in the system (about 15 miles away) instead of hiring another teacher and splitting the class. There are 30 kids in kindergarten now. They decided at the last minute last year to split the class - 20 with an aide, 10 in a class without. Not sure if this matters or not, but her home school has made AYP and the other school has not.
