Okay, so I just learned today that my case is NOT an isolated event. DLA has changed the game... If you have children from a divorce and the non-custodial parent has visitation rights, the visitation schedule will be scrutinized... Please ensure it addresses long distance situations. (You may even want to address living overseas specifically! For example, do not give non-custodial parent visitation rights over short vacation periods like Thanksgiving or Christmas unless non-custodial parent is flying out to visit child if child is under a certain age! Well, not unless you are willing to pay for the cost to fly both you and the child(ren) to the other parent.) Include verbiage about unlimited access via telephone and videoconferencing also.

If not, you will not be issued travel orders until this is done -- no exceptions!!!

micorazonkilleen That may suffice as is, it it up to DLA. At this point in time, no one knows what DLA is looking for exactly. However, if DLA doesn't like the visitation rights as it stands, your friend will be required to go to court and get a revised court order. As the current visitation order is court mandated... micorazonkilleen My situation was different as we had generic visitation schedule wherein ex received 114 days a year to include every other weekend, every other holiday, etc... red flag for DLA... the letter granting permission to leave the country is no longer sufficient in those cases any longer it seems....

So if she receives the court paperwork for the visitation modification (she's having to go that route), will she also need a letter from her ex stating he will allow the child to move overseas? Or will the paperwork from court be all that is needed? Thank you for all the great info! Sometimes contacting HR is not so easy....See More

micorazonkilleen I say, yes, still include the notarized letter granting permission to move overseas so there is no doubt that he has been notified. Besides, he will still have to sign/notarize DS-3053 for official passport for minor child(ren).

micorazonkilleen HR will let your friend know if DLA will require her to go to court or not. I wouldn't worry. If she hasn't heard anything yet, she may be in the clear. Just have her ask HR to touch base with them regarding visitation rights... :-)
