Just to clarify.... I was half asleep when I wrote this and I might not have explained this correctly. My question really is are we allowed to do this being that we can control our schedules. I'm not asking if we can get over on them by doing this I'm asking if it's allowed.

I do what you are saying to avoid morning calls but just be careful and aware when accepting and denying calls and you will be ok.
