This is a fine method (placing it on your desk). In my school there have been several occassions where a student has had there cell phone taken by the teacher, and the cell phone was placed on the desk. The teacher was teaching and the bell rang, the student was told to take the phone back. The student said the phone was taken by another student. They play games and this student may have even had the phone the whole time. The teacher was held accountable and forced to pay for the phone. In another occassion, the teacher put the phone in her desk only to find when she went back for it the next period, she forgot and allegedly the student forgot to ask for it back. The cell phone dissapeared. the teacher again had to pay for it. My point of this post, be careful if you take a phone from a student. We have a no phone policy in our building which is not enforced and yet if you touch it you are responsible. I agree with you In the district where I am subbing, we are specifically told not to demand a student's phone. As you say, something could happen to it and you would be liable. Also, when you demand a student's phone, they are likely to act like a grizzly bear when someone tried to take her cub.
